Court injunction blocks enforcement of recent changes made to the FLSA
On November 22nd, a preliminary court injunction was issued blocking the enforcement of the changes made to the Fair Labor Standard Act (FLSA) set to go into effect on December 1st. These changes referred to as “The Final Rule,” were outlined in the Fair Labor Standards Act- Frequently Asked Question Document (FAQ-FLSA) sent to your church and available now on the administrative toolkit.
This means the changes announced by the Department of Labor (DOL) regarding salary thresholds for exempt workers is on hold. There are several possible outcomes from this injunction, the law could still go into effect at a later date, the law could be implemented at a later date but with different rules, or the law may be repealed.
There are two options for churches based on this injunction. Churches may hold off on implementing the changes until a decision is reached by the court or the church may choose to continue with implementation of the changes.
It is important to note that the ministerial exception as outlined in the FLSA-FAQ is a long-standing exception and therefore still applies regardless of the injunction.
Foursquare will continue to stay updated on this case and send out a communication once the courts reach a decision.
